1.2.  The user of this site represents that he/she has read this Terms of Use section, and he/she irrevocably accepts its stipulations and instructions, and he/she or anyone on his/her behalf will have no demand and/or claim against this website, its owners and/or managers and/or anyone on their behalf, and/or The Hotel.

1.3.  In part of the contents of this internet site the grammatical male form is used for convenience only. Everything in the content of this site refers to both males and females.

1.4.  The user represent that the information presented on this website or and/or any part hereof, is the sole property of The Hotel, and The Hotel holds the copyrights to the information and/or any part hereof, and the user undertake to use the information in this site and/or any part hereof for his/her personal use only, and not to copy, photograph, duplicate, transmit, print or published to any person or body the information in this site and/or any part hereof, whether it is owned by The Hotel or a third party, without the prior written consent of The Hotel, except for personal, non-commercial use of the information.

1.5.  The user undertakes not to alter or otherwise make any changes to the information, or take any action that may impair the correctness of the information and its credibility, or the good name of The Hotel as the information’s copyrights holder, or any other person.

1.  Risks and responsibility

2.1.  The user declares that he/she knows that the use of this internet site involves many risks, both due to the technology involves, and to human factors that are active through the internet.

2.2.  The user bears sole responsibility for any use he/she makes or will make of the information.

2.3.  The information is for the sole use of the user alone, and using it, including any reference to it, is the user’s sole responsibility. Inter alia, the user represents that he/she is aware of the fact that photographs displayed on the site are for illustration purposes only, and the appearance of these photographs as displayed on the computer screen may differ from their appearance in reality.

2.4.  The information is displayed on the site as is, and The Hotel is not responsible for the suitability of the information to the user’s needs, and is not responsible for the ability or inability to use the information for any purpose whatsoever. The user alone has the sole responsibility for the manner in which he/she uses the information.

2.5.  The Hotel does its best to ensure that the information is as accurate as possible; however the information does not pretend to comprise a complete or detailed analysis of the subject matter detailed herein. The information is general only, and may be partial and incomplete. The Hotel shall bear no responsibility for any mistakes in the information displayed on the site, whether by The Hotel or third parties.

2.6.  The Hotel shall not be responsible to any damage, inconvenience, loss, expanse or grief that may be caused to the user or his/her property (including the user’s hardware or software) or any third party, directly or indirectly, as a result of entering the site and using its content.

2.7.  The Hotel shall not be responsible to any changes made to the information by the user and/or any third party.

1. Booking and reservations

3.1.  General

3.1.1.      The user is permitted to use this internet site for the sole purpose of booking and reservations of services, and shall not use this internet site for any other purpose.

3.1.2.      Booking a room in The Hotel can be done by a phone call to the hotel’s booking center on 04-9958568/416, or through this site.

3.2.  Details of the services purchaser

3.2.1.      When purchasing services through this internet site and booking as detailed below, the user shall be required to enter his/her personal details, including ID or passport number, number of credit card, and details of guests who will be staying with him/her.

3.2.2.      The owners of this internet site and/or its operators, and/or its proprietors, and/or anyone on their behalf, shall not be responsible for any mistake made by the user in typing the details of the purchase, including a mistake in selecting the holiday package deal, date, number of beds, and any other service that is ordered by the user through this internet site, and shall not bear any direct or indirect responsibility in case the purchase details are not received in the system, and/or any technical problem, and/or any other problem that will prevent the user from purchasing services through the site.

3.2.3.      Entering false purchase details is a criminal offense, and legal action shall be taken against people who will enter false details, including damage claims for damages that may be caused to The Hotel and/or this internet site and/or its operators and/or proprietors and/or managers or anyone on their behalf.

3.2.4.      The user represents that he/she knows that by entering purchase details, he/she is entered in The Hotel’s data pool. The Hotel shall be entitled to use the purchase details for improving services that it offers to the site user, and for contacting the user through post, email and any other communication means, and adapting the site to the user’s personal needs and requirements.

3.3.  The booking method

3.3.1.      The user shall enter the order details on the site.

3.3.2.      While entering the order details, the user shall be required to enter credit card details, which shall be used as a collateral only, except for national holidays and the months July and August, in which a 10% advance payment shall be required, which will not be reimbursed in case of cancellation for whatever reason.

3.3.3.      Payment shall be made in full in cash or credit card upon checkout.

 

1. Conditions and limitations

4.1.  Prices on this internet site are in New Israeli Shekels and include VAT (except in Eilat), according to the prevailing VAT rate at the time.

4.2.  The Hotel is entitles to change the prices of holiday deals and booking terms at any time.

4.3.  The Hotel is entitled to change the Terms of Use of this internet site from time to time without a prior notice to the user. The Hotel shall publish the new terms on the site, and they will become valid at the time of publishing.

4.4.  The Hotel is entitled to close down the site and change its structure, content, look, and the choice and availability of the services and content offered herein, and any other aspect with regard to the site and its operation, all without prior notice to the user. The user represents that he/she shall have no claim or demand from The Hotel concerning those changes.

4.5.  The number of places in The Hotel is limited, and booking rooms is done on the basis of availability only.

4.6.  Special deals and discounts do not apply simultaneously.

4.7.  Check-in and check-out

4.7.1.      Check-in: on week days at 15:00, Saturday and holiday at 18:00.

4.7.2.      Check-out: on week days until 11:00, Saturday and holiday until 15:00.

4.7.3.      Check-in and check-out before/after the above-mentioned hours is subject to prior approval of The Hotel management, and involves extra cost.

4.8.  Babies and children

4.8.1.      Definitions: “Baby”
“Child”: up to 12 years old

4.8.2.      Babies, children and youth under 18 are accepted only if accompanied by an adult above 21 years of age.

4.9.       The laws of the State of Israel govern this agreement. The competent courts of Haifa shall have exclusive jurisdiction in any matter resulting from this agreement and the use of this internet site.

4.10.   The user acknowledges that an Internet site might suffer technical failures by definition.

4.11.   The Hotel is not responsible for any mistakes in the content of this internet site.

1. Cancelations

5.1.  Booking that is canceled up to 14 days before the arrival date shall be charged NIS 200 only.

5.2.  Booking that is canceled less than 24 hours before the arrival date will be charged the full cost of the first night.

5.3.  On holidays, vocation periods and during the months July-August, a 10% advance payment shall be paid, which would not be reimbursed in case of cancellation for whatever reason.

1. Swimming pool complex

6.1.  Children up to 18 years old can use the swimming pool only under the supervision of an adult, and at the responsibility of the guests. You are requested to observe the rules and regulations at the swimming pool complex.

1. Miscellaneous

7.1.  The presence of animals is subject to prior approval of The Hotel management.

7.2.  No additional guests beyond the number stated on the reservation are allowed, without the prior approval of The Hotel. Inviting guest to the hotel/swimming pool complex, with or without lodging, shall be charged at extra cost.

7.3.  Taking equipment out of the rooms is prohibited. Guest are advised to bring their own private towels for use outside the hotel complex.

7.4.  Smoking in the hotel complex is prohibited, except in the designated areas.

7.5.  Guest undertakes to leave the kitchen clean and undamaged upon leaving the hotel.

1. Taking care of the premises

8.1.  The user undertakes to on behalf of himself and all other guests who accompany him, to take care of the premises and all the equipment therein, and cause no damage either deliberately or as a result of negligence.

8.2.  The user confirms that in case of any damage whatsoever, his credit card shall be charged to the full extent of the damage cost.
